September 2, 2011. Derek J. Howell, Esq., talked about the 14th Amendment’s so called “incorporation doctrine,” the Blaine Amendment and whether the 14th Amendment was properly ratified. The title of his talk was, “The Incorporation Indoctrination: How the 14th Amendment Is Used to Subvert the Constitutional Powers of the States.” He told about how he made his transition from state trooper to attorney and how IOTC was significant during his time in law school.
The 14th Amendment has and is being misused to apply some, but not all, of the federal Bill of Rights to the states. This is commonly referred to as the “incorporation doctrine.” So how has this impacted America? Have you ever wondered why even though the 1st Amendment provides the CONGRESS “shall make no law respecting and establishment of religion, or prohibiting the free exercise thereof…” that state and local civil governments are prohibited from having school prayer, memorial crosses or acknowledging Christ at Christmas. Derek will explain how this Amendment is being used to restrict states from exercising their Constitutional powers.

Derek J. Howell, Esq., is a decorated former Maryland state trooper, to include awards of the Maryland State Police Commander’s Award, the United States Customs Service Award, Maryland Chiefs of Police Award, 1999 Baltimore Sun’s Police Officer of the Year Award- “Award of Merit,” 1998 Maryland State Police Drug Enforcement Command’s Trooper of the Year, and Maryland State Police Superintendent’s Award for the Washington Beltway Sniper Investigation. Derek spent over ten years with the Maryland State Police, including working undercover on a federal task force, before leaving to obtain his Juris Doctor, cum laude, from the University of Baltimore School of Law.
Derek earned his Bachelor of Science and Master of Science degrees, both with honors, from the Johns Hopkins University. He is an attorney, college instructor and Director of Operations for the Institute on the Constitution. Derek is admitted to the United States District Court for the District of Maryland and licensed to practice law in the State of Maryland.
In 2010 Derek was elected to the Harford County Republican Central Committee. His colleagues on the committee unanimously elected him Vice-Chairman. Derek is an Adjunct Faculty Member of the Community College of Baltimore County where he teaches Criminal Justice & the Constitution and Introduction to Law.
Derek is a Christian. He is happily married to his wife, Jenna. Derek and Jenna were recently blessed to have their first child, a son, Hudson.
